A “durable” power of attorney will remain in effect even if you become incapacitated but will end upon your death. The executor's role takes responsibility after death.
When a person (the principal) signs a power-of-attorney, he gives another person (the agent) the power to act in their place and on behalf of the principal, in managing their assets and affairs. The agent's powers may be broad and sweeping to include almost any act that the principal might have performed. Leaving gaps in authority can cause issues to arise in the management of a person’s affairs.
It should be noted that in general, inherently testamentary acts, such as the authority to make or revoke a will, may not be performed by an agent.
